The petitioner seeks bail in connection with Palasi P.S. Case No. 68 of 2014, registered under Sections 376 and 493 of the Indian Penal Code.
The allegation of informant is that she was doing the work, as a maid, in the house of the petitioner. Before 8 months, petitioner developed physical relation with the informant on the pretext to perform the marriage with her. The parents of the informant married her at other place, where it was detected that she was carrying five months pregnancy and after knowing this fact, her husband left her. Thereafter, a Panchayati was convened and in the said Panchayaity, petitioner was ready to perform marriage with the informant, but later on he refused to

Learned counsel for the petitioner submits that, in fact, informant has been left by her husband due to pregnancy conceived by her before the marriage and thereafter only to give pressure upon the petitioner to perform the marriage, the informant has lodged the preset case. Further submission is that Chargesheet has already been submitted in this case and the petitioner is in custody since 16.12.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM 3rd, Araria in connection with Palasi P.S. Case No. 68 of 2014.
