No one appears on behalf of the opposite parties although the name of the counsel Manager Sah appears on the cause list who has filed counter affidavit in the matter. The present petition has been preferred transfer of Matrimonial Case No. 489 of 2018 from the court of Principal Judge, Family Court, Patna to the court of Principal Judge, Family Court, Rohtas at Sasaram.
It has been contended by the learned counsel for the petitioner that she has some illness, depended upon father, has grown up children studying in school and no financial support from the husband and as such she is unable to move from Sasaram to Patna.
No one is appearing on behalf of the opposite parties. On perusal of the counter affidavit, there is no
Patna High Court MJC No.4392 of 2018(6) dt.06-07-2023 2/2 whisper either on the financial support and/or readiness to pay the travelling allowances whenever the lady visits to Patna. In the case.
In that view of the matter, the prayer of the petitioner is allowed.
The Matrimonial Case No. 489 of 2018 presently pending in the Court of Principal Judge, Family Court, Patna is transferred to the Court of Principal Judge, Family Court, Rohtas at Sasaram.
The MJC No. 4392 of 2018 is disposed of.
