The petitioner seeks bail in connection with Kotwali P.S. Case No. 472 of 2019 for the offence under Sections 20 and 22 N.D.P.S. Act.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner. The petitioner is rotting in judicial custody since 06.12.2019.

Learned A.P.P. for the State has opposed the prayer for bail and submitted that altogether 3 Kg and 650 gram

Patna High Court CR. MISC. No.19484 of 2020(3) dt.09-07-2020 2/2 Ganja has been recovered from the house of the petitioner, which is evident from the seizure list, which indicates that the petitioner is involved in illegal business of Ganja Considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of this petitioner is rejected.
