The petitioner is an accused in connection with Bhagalpur GRPS P.S. Case No. 25 of 2017, registered under Section 379 and 411 of Indian Penal Code, pending in the Court of SDJM, Railway, Bhagalpur.

The allegation of informant, namely, Kabita Pandey is that on 08.02.2017 at about 4.20 P.M., when she was going to board in the train at Bhagalpur Railway Station then one person snatched her golden chain from her neck. Thereafter, she caught hold his hand and made alarm then GRP Police came and apprehended him, who disclosed his name as Shalim Mulla (Petitioner). On search, the golden chain of the informant was recovered from his pocket. Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.16601 of 2017 (3) dt.03-05-2017 2/2 submits that petitioner has falsely been implicated in this case mere on suspicion. The petitioner is in custody since 09.02.2017. Learned counsel for the State vehemently opposed the prayer of the petitioner.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
