2. The petitioner seeks regular bail in Kundwa Chainpur P.S. Case No. 330 of 2025 dated 05-12-2025, registered under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022.

3. The allegation is of recovery of 72 litres of Nepali country made liquor from the land of Tulsi Sah situated on Sainik Road (Kharua Parsa). It is alleged that on seeing the police party, petitioner tried to flee away and on chase he was apprehended.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the

It is further submitted that no contraband was recovered from the conscious possession of the petitioner; rather, the alleged liquor was recovered from the field of Tulsi Sah. The petitioner has been made an accused on the basis of mere suspicion. It is lastly submitted that the petitioner has been in judicial custody since 05-12-2025 and has no criminal antecedents.

5. Learned Additional Public Prosecutor for the State has opposed the prayer.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 3, Civil Court, East Champaran at Motihari, in connection with Kundwa Chainpur P.
