JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Govindpur P.S. Case No. 118 of 2013 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

Although, there is case and counter case between the parties but there is specific allegation against the petitioner that he gave a blow of butt of pistol to the informant and the impugned order of learned Sessions Judge reveals that informant sustained grievous injury on his head.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant the

Patna High Court Cr.Misc. No.9882 of 2015 (2) dt.17-03-2015 privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Govindpur P.S. Case No. 118 of 2013 pending in the court of Chief Judicial Magistrate, Nalanda stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
