The petitioner seeks regular bail in connection with Paharpur P.S. Case No. 134 of 2016 registered for the offences punishable under Sections 392 of the Indian Penal Code. The informant in his written report submitted before S.H.O. has alleged that when he was returning by his motorcycle on 11.07.2016 three unknown miscreants intercepted and snatched his motor-cycle and his belongings.
Learned counsel for the petitioner submits that the petitioner is neither named in the F.I.R. nor any incriminating material has been recovered from his possession. The petitioner was apprehended in connection with Govindganj P.S. Case No. 222 of 2016 in which his alleged confession was recorded by
Patna High Court Cr.Misc. No.5860 of 2017 (2) dt.08-02-2017 2/2 Police. On the basis of his alleged confession, he has been implicated in the present case. The petitioner has been allowed bail by another co-ordinate Bench of this Court in the said Govindganj P.S. Case No. 222 of 2016. Except the involvement of this petitioner in Govindganj P.S. Case No. 222 of 2016, there is nothing on record to show his complexity in the present crime. There is no antecedent against the petitioner and the petitioner is in custody since 14.11.2016.
Learned APP for the state opposed the submission. Considering the nature of allegation and the facts and circumstances stated above, the prayer for bail application is allowed. The petitioner, Suraj Kumar, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Paharpur P.S.
