The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman and the learned counsel for the petitioner submits that allegation as alleged in the FIR is that the candidates who appeared during counseling for appointment as primary teacher for the year 2019-2021 submitted false certificate on account of which the appointment process was cancelled. The learned counsel submits petitioner has been falsely implicated in the present case, it is next submitted no appointments have been made as
Patna High Court CR. MISC. No.16441 of 2023(2) dt.25-05-2023 2/2 such, no question arises of submitting false documents for securing job. The learned counsel next submits that similarly situated co-accused has been granted anticipatory bail by order dated 28.04.2023 in Cr. Misc. No. 13130 of 2023 by a learned Coordinate Bench.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sahar P.S. Case No. 136 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
