The petitioner seeks regular bail in connection with Sessions Case No. 175 of 2019 arising out of Chanan Police Station Case No. 105 of 2019, registered for the offences punishable under Sections 413/414 of the Indian Penal Code. The allegation against the petitioner is that one stolen motorcycle was recovered from the possession of the petitioner and apart from the present case, the petitioner is involved in five other criminal cases.
Learned Counsel for the petitioner submits that the
Patna High Court CR. MISC. No.14321 of 2020(2) dt.03-06-2020 2/3 petitioner had earlier moved for regular bail before this Court by filing Criminal Misc. No. 85328 of 2019 and this Court, while rejecting the prayer for bail of the petitioner, had granted him liberty to renew his prayer for bail after framing of charge. He, referring to Annexure 3, submits that charge has been framed against the petitioner by the learned Court below. After having heard learned Counsel for the parties and taking into consideration the observation of this Court made in Criminal Misc. No. 85328 of 2019, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Lakhisarai, in connection with Sessions Case No. 175 of 2019 arising out of Chanan Police Station Case No. 105 of 2019, subject to the conditions that (i) one of the bailors would be his father and (ii) the petitioner will appear on each and every date fixed in the case and his bail bonds would be cancelled if he fails to appear on two consecutive dates.
It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding
