The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 307/34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case is that on 07.03.2015 at 11.00 P.M. the informant was sleeping inside the house, in the meantime, FIR named accused persons including the petitioner came, resorted to indiscriminate firing and one empty cartridge was recovered from the place of occurrence.

It is submitted by learned counsel for the petitioner that the petitioner is the agnate of the informant and in the background of partition suit the accusation has been levelled.

Patna High Court Cr.Misc. No.6846 of 2016 (2) dt.15-02-2016 2/2 For the occurrence of 07.03.2015 the FIR was registered on 10.03.2015. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case and the fact that no injury was caused to anyone, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 79 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
