The petitioner seeks bail in connection with G.O Case No. 10 of 2017 (Manigachhi P.S. Case No. 03 of 2017), registered under Section 30(A) of Bihar Excise and Prohibition Act, 2016.

The accusation is that on suspicion, Raja Choupal and Hari Narayan Choupal were apprehended by the Police and one bottle of India made foreign liquor recovered from their possession. On query, they disclosed that they had purchased the said liquor from the shop of the petitioner. Thereafter, grocery shop of the petitioner was searched and 3 bottles, each containing 180 ML, 3 bottles each containing 375 ML and one

Patna High Court Cr.Misc. No.13468 of 2017 (3) dt.20-04-2017 2/2 bottle of 375 ML of India made foreign liquor recovered. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent is in custody since 04.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Darbhanga in connection with G.O. Excise Case No. 10 of 2017 (Manigachhi P.S. Case No. 03 of 2017.
