JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner is in jail custody for near about two years but Police Inspector, Daudnagar, has reported that petitioner has criminal incident of five cases though petitioner has disclosed only two cases at Para- 3 to the petition. It appears that in the aforesaid petition, the petitioner has intentionally suppressed his criminal antecedent.

Accordingly, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Daudnagar P.S.Case No. 176 of 2015, pending in the court of Sub Divisional Judicial Magistrate, Aurangabad is again rejected.

No.13558 of 2017 (4) dt.28-06-2017 2/2 However, the learned trial court is directed to expedite the trail of the petitioner and try to conclude the same preferably, within four months from the date of receipt/ production of a copy of this order. It is also made clear that if the trial court fails to conclude the trial of the petitioner within the above stated period of four months without any fault of the petitioner, the petitioner may renew his prayer for bail before the learned trial court itself.
