JUSTICE SHIVAJI PANDEY ORAL ORDER 16-07-2015 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Barahara (Krishnagarh) P.S. Case No. 279 of 2013 registered for offences under sections 406, 419, 420, 467 and 468 of the Indian Penal Code.

Allegation has been made of hacking the bank account and making on line purchase. This act has been done by the petitioner and his associates, namely, Ravindra Kumar. When the petitioner had gone to take delivery from the courier, he was caught raid handed.It has been submitted that Ravindra Kumar, his associate, has been granted bail by the court below on account of the fact that his brother has returned the amount to the sufferer.

No.9937 of 2015 (4) dt.16-07-2015 2/2 In such view of the matter, in the event of the petitioner's arrest or surrender before the court below within four weeks from the date of communication of this order, let the above named petitioner be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri A.K. Manjhi, Judicial Magistrate 1st class, Ara in connection with Barahara (Krishnagarh) P.S. Case No. 279 of 2013 , subject to the condition as laid down under Section 438 (2) Cr. P.C.

The court below is directed to make verification of the fact whether the amount has actually been returned by Ravindra Kumar or not and only thereafter the bail bond of the petitioner will be accepted so long the verification is not made by the court below, the Police will not take coercive steps against the petitioner in connection with Barahara (Krishnagarh) P.S. Case No. 279 of 2013.
