This application is for grant of bail in connection with Tekari P.S.Case No.21 of 2017 for the offence under Sections 457, 380 and 411 of the Indian Penal Code.

It is submitted on behalf of the petitioner that due to previous enmity with the informant, he has been made accused in this case and he is no criminal antecedent. The petitioner is in custody for about 2 1⁄2 months.

Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioner, stating the petitioner was arrested at the spot. Having heard both sides and in view of the fact that he has been arrested at the spot, I am not inclined to grant bail to the petitioner at this stage. However, considering the fact that the

No.13587 of 2017 (2) dt.22-03-2017 2/2 petitioner is in custody, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the learned court below itself, who will consider the period of custody of the petitioner as well as the materials available at that time, and will pass appropriate order without being prejudiced by the order of this Court.. With the aforesaid observation, this application is dismissed.
