====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 18-06-2026 Heard learned counsel for the petitioner and learned counsel for respondent-State and Bihar State Madarsa Education Board.

2. With the consent of the parties, the present writ application is being disposed of at this stage itself.

3. The petitioner in the present writ application has prayed for the grant of following reliefs:

"(a) For issuance of an appropriate

2/4 writ/writs, order or direction in the nature of Mandamus, commanding the respondent Bihar State Madrasa Education Board to cancel the Wastania (8th) Examination Certificate, bearing Registration No.- SUP-01346/13, Roll No.- SUP-01346, and the Fauquania (10th) Examination Certificate, Marks-Sheet and all allied records issued in the name of "Fatma Khatoon", bearing Registration No.- SUP-66635/15, Roll No.- 719, Roll Code-SUP, as the same contain incorrect, erroneous and inconsistent particulars relating to the petitioner's name, date of birth and mother's name.

(b) To direct the respondent Board to treat the said Wastania (8th) and Fauquania (10th) educational Certificates as void ab-initio, having been obtained on the basis of incorrect and inconsistent particulars relating to name and date of birth.

(c) For issuance of an appropriate writ/writs, order or direction in the nature of Mandamus, directing the respondent authorities to either cancel the aforesaid Wastania (8th) and Fauquania (10th) educational Certificates or, in the alternative, to rectify and correct the same strictly in accordance with the petitioner's correct name, date of birth and mother's name, as supported by valid and authentic records.(d) For any other relief/reliefs that the petitioner may be found to be entitled to in the facts and circumstances of the present case."

4. After advancing some argument, learned counsel

3/4 for the petitioner submits that for seeking the aforesaid relief the the petitioner has already filed a representation before the Secretary, Bihar State Madrasa Education Board (respondent no.2) which is dated 29.11.2025 (Annexure-P/6) and the same continues to be pending. He, therefore, prays that the petitioner would be satisfied if an appropriate direction could be issued to the Bihar State Madrasa Education Board through its Secretary to dispose of the pending representation of the petitioner within a fixed time frame, after giving an opportunity of hearing to the petitioner.

5. To the aforesaid submission made by learned counsel for the petitioner, learned counsel appearing for respondents-State and Bihar State Madarsa Education Board do not have any objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of directing the Bihar State Madarsa Education Board, Patna to dispose of the pending representation of the within three months from the date of production of a copy of this order, after giving an opportunity of hearing to the petitioner as well as after hearing all other parties including Madrasa Shajratul Uloom. Needless to emphasize that the final

4/4 order which shall be passed should be a reasoned and speaking order and in case the petitioner is found entitled to the relief the same should be extended to the petitioner.

7. With the aforesaid observation and direction the present writ application stands disposed of. All pending I.As, if any will be deemed to have been disposed of.
