The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

650 ml. of foreign liquor has been recovered from the possession of co-accused Aman, and petitioner has been made accused due to the fact that he is own brother of coaccused Aman, who was apprehended on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and he has been made accused only on suspicion. Petitioner has no criminal antecedent.

No.11429 of 2022(2) dt.08-07-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. 2, Muzaffarpur in connection with Excise P.S. Case No. 123 of 2021 / P.R. No. 12 of 20202021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
