JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 27(b)(ii), 27(d) of the Drugs and Cosmetics Act and Section 7(i) of Essential Services Maintenance Act.
Four cartoons of physician sample medicines were being transported through an auto rickshaw when consignor was M/s Medi Surgicals, Jogbani and consignees were Sushil Kumar and M/s Laxmi Medicals. During investigation, it was found that through mobile number registered in the name of son of the petitioner, talk about 15 times was made with the consignor and other persons who were carrying sample.
It is submitted by learned counsel for the petitioner that petitioner is not connected with the alleged physician sample and
Patna High Court Cr.Misc. No.13021 of 2015 (2) dt.06-05-2015 2/2 only on suspicion, the accusation has been levelled and co-accused Sushil Kumar has been granted anticipatory bail vide Cr. Misc. No. 629 of 2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Patna in connection with Jakkanpur P.S. Case No. 341 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
