The petitioner apprehends his arrest in TR No. 5051 of 2015, arising out of C.R. No. 993 of 2014 registered for the offences punishable under Section 498A and other Sections of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.

The wife of the petitioner made allegation that the petitioner subjected her to all sorts of physical and mental torture. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife on any undertaking. Considering the facts aforesaid, the petitioner above

Patna High Court Cr.Misc. No.12994 of 2017 (5) dt.23-06-2017 2/2 named is directed to surrender in the court below within four weeks from the date of receipt/production of a copy of this order and after issuing notice to the complainant, the court below shall enlarge the petitioner on provisional bail for four months on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate-Madhubani, in TR No. 5051 of 2015, arising out of C.R. No. 993 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. if the petitioner keeps his wife properly the court below shall confirm the provisional bail of the petitioner and if the petitioner fails to keep his wife properly the court below shall pass order on provisional bail of the petitioner in accordance with law immediately after expiry of four months.
