This application for regular bail arises out of Mahua P.S. Case No. 610 of 2020, disclosing offence punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)/26/35 of the Arms Act.
It is alleged that the petitioner and some other coaccused persons had assembled with arms to commit dacoity and were arrested. From the petitioner's possession, one country made pistol and 3 live cartridges were recovered. The petitioner is in custody since 22.10.2020.
Learned counsel for the petitioner has submitted that in similar circumstance co-accused Manish Kumar has been
Patna High Court CR. MISC. No.22782 of 2021(2) dt.29-11-2021 2/2 allowed regular bail by this Court by order dated 15.09.2021 passed in Cr. Misc. No. 23155 of 2021. Petitioner has one criminal antecedent as mentioned in paragraph 3 of the application.
Considering the fact that the petitioner in in custody since 20.10.2020, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P.S.
