Petitioner seeks bail in a case registered for the offence punishable under Section 20 of the NDPS Act.

9.5 kg ganja has been recovered from the Bathan of the petitioner and taking note of the aforesaid fact, the prayer of the petitioner was earlier rejected by this Court vide order dated 16.10.2015 passed in Cr. Misc. No. 4773/2015 at initial stage of the case.

However, it is informed on behalf of the petitioner that uptill now trial of the petitioner could not be concluded. It is also submitted on behalf of the petitioner that the First Information Report goes to show that it was co-accused Vijay Mahto who had

Patna High Court Cr.Misc. No.3544 of 2017 (2) dt.29-03-2017 2/2 brought the ganja and kept at the Dalan. Vijay Mahto has already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as this aspect of matter that the petitioner is in jail since 28.09.2014 and does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Chapra in connection with Sonepur P.S.
