JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 130 of 2013 registered for the offence punishable under Section 396 of the Indian Penal Code. It appears from perusal of the impugned order that in course of investigation, witnesses stated the name of the petitioner and moreover, para-3 to the petition reveals that petitioner carries criminal antecedent of nine cases.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his
Patna High Court Cr.Misc. No.7864 of 2015 (2) dt.02-03-2015 prayer for anticipatory bail in connection with Bathnaha P.S. Case No. 130 of 2013 pending in the court of Chief Judicial Magistrate, Sitamarhi stands rejected.
