The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 325, 379, 504, 506/34 of the Indian Penal Code. As per prosecution case, the informant alleged that while his sons were returning home after closing their shop, in the meantime, the petitioner along with other accused persons intercepted and assaulted them. The accused persons are said to have snatched cash of Rs. 30,000/- from both sons of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner has falsely been implicated in this case due to ulterior

Patna High Court CR. MISC. No.12192 of 2023(2) dt.24-04-2023 2/2 motive. There is case and counter case between them, both parties sustained injuries as alleged in separate occurrences. As per the injury report annexed as Annexure-3, it appears that all injuries received by the injured are simple in nature except one. It is further submitted that other co-accused persons have already been granted bail by this Court vide order dated 20.4.2023 passed in Cr. Misc. No. 11022 of 2023. Moreover, he is languishing in judicial custody since 9.1.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chand P.S. Case No. 315 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Kaimur (Bhabhua).
