The petitioner apprehends his arrest in a case under Section 47(a) of the Excise Act and Section 314 of the Explosive Substance Act.
The police officials raided a place situated near a canal and found 10-12 persons fleeing away from there. On search, 80 litres of country made liquor, bombs and some other materials for preparing liquor were recovered. The informant named Arjun Rajbanshi and others. The petitioner is not named in the F.I.R. Name of the petitioner transpired during the course of investigation as he happens to be the brother of Arjun Rajbanshi but nothing has been recovered from the possession of the petitioner. The petitioner has no criminal antecedent. Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.16028 of 2015 (3) dt.02-07-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Sirdala P.S. Case No. 45/2001, corresponding to G.R. No. 643/2001, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
