JUSTICE SANJAY PRIYA ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 133 of 2017 arising out of Sakara P.S. Case 290 of 2016 instituted for the offence under Section 366(A) of the Indian Penal Code. It is alleged in the written report that minor daughter of the informant went to Rukanpura for computer class and did not return. The girl after recovery has given her statement under Section 164 Cr. P.C. wherein she has stated that this petitioner talked from Mobile phone of her mother and told her to send the daughter of the informant as there was computer exam. Thereafter, the mother of the informant sent the victim to school for taking computer exam, but the victim girl was taken to Delhi by the petitioner.

Patna High Court Cr.Misc. No.13015 of 2017 (3) dt.02-05-2017 In this manner, from the narration of the statement under Section 164 Cr. P.C. itself it appears that no force was applied by the petitioner against the victim girl. She voluntarily went after receiving telephone call by the petitioner. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 133 of 2017 arising out of Sakara P.S. Case No. 290 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
