NILU AGRAWAL ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 24.04.2017 in connection with Rampur P.S. Case No. 57 of 2017, G.R. No. 1284 of 2017 registered for the offence punishable under Sections 456, 354(B), 380, 504, 506/34 of the Indian Penal Code. The prosecution case is that the petitioner along with his brother and two others entered into the house of the informant in the night and tried to establish sexual relation with her, but on hulla raised by her, accused persons went away with cash and threatened her not to go to police station as they are musclemen. It has been submitted by the counsel for the petitioner that he is innocent, bears no criminal history and there was

He further submits that no overt act has been alleged to have been committed by the petitioner and the petitioner is a man of means and has home and hearth in the village, hence, there is no chance of absconding. However, learned A.P.P. for the State opposes the prayer for bail.

Be that as it may, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 57 of 2017, G.R. No. 1284 of 2017, subject to the condition that the petitioner will cooperate with the investigation and will appear before the police/ Court as and when required.
