In this case, the petitioners have prayed for grant of anticipatory bail in connection with Bahadurpur (Pataur O.P.) P.S. Case No. 206 of 2018 registered for offence punishable under sections 406/420/379/34 of the Indian Penal Code, making statement that they have wrongly been framed in the present case.
The counsel for the State has pointed out that petitioner has been granted police bail under section 41 (1) of the Code of Criminal Procedure.
In such view of the matter, this application is not
Patna High Court Cr.Misc. No.10687 of 2019(2) dt.22-02-2019 2/2 maintainable. If the petitioners surrender before the court below, the court below will examine as to whether they have violated the terms and conditions of the bail during the period of privilege of bail. If the petitioners have not violated the terms and conditions of bail, the court below on its own merit will decide the case and take decision in accordance with law, laid down in the case of Mahendra Pd. Singh vs. The State of Bihar 2004 (3) PLJR 491.
Accordingly this application is disposed of.
