Petitioners apprehend their arrest in a case registered for the offence punishable under sections 304 (B), 34 of the Indian Penal Code.

It is a case of dowry death.

Petitioner no. 1 is brother whereas petitioner no.2 is the cousin of the husband of the deceased.

It is submitted that the petitioners are innocent and have falsely been implicated in this case. As per the Post Mortem Report, "no external injury was seen". There is no specific allegation against these petitioners in the F.I.R. It is

Patna High Court CR. MISC. No.11153 of 2023(5) dt.04-07-2023 2/2 further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the deceased who is already in custody since 25.07.2022. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Learned Additional District and Sessions Judge-VII, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 625 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
