JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-03-2021 Heard the learned counsel for the petitioner and Sri Prabhat Kr. Verma, the learned AAG 3 for the State. The learned AAG-3 has produced a draft bearing no. 840876 dated 04.03.2021 for a sum of Rs. 25,55,295/-, as per the undertaking of the Director General of Police, Bihar, Patna, as recorded in the order dated 03.03.2021, in compliance of the judgment of this Court dated 19.04.2019, passed in C.W.J.C. no. 8471 of 2003, pertaining to the amount of arrears of back wages.

The learned counsel for the petitioner does not dispute the fact that the petitioner has already joined in pursuance to the

Patna High Court MJC No.538 of 2020(5) dt.05-03-2021 2/2 setting aside of the order of termination by this Court vide order dated 19.04.2019 and is also getting regular salary. In view of the facts and circumstances, mentioned in the order of this Court dated 03.03.2021, I direct that the aforesaid draft dated 04.03.2021 be kept in safe custody by the Registrar General of this Court, which shall be disbursed, subject to the final outcome of the appeal filed by the contemnors bearing L.P.A. no. 128 of 2021.

The petition stands disposed off, however with liberty to the petitioner to file appropriate interlocutory application for revival of the present petition, in case the aforesaid appeal bearing L.P.A. no. 128 of 2021 is dismissed.
