====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sessions Trial No.25 of 2019/ 64 of 2019 arising out of Kako P.S. Case No. 220 of 2018 registered for the offence under Sections 341, 323, 302, 504, 506 and 34 of the Indian Penal Code.

It appears that a report was called for regarding the present stage of the trial vide order dated 27.08.2021 and in compliance thereof same has been received from the Additional Sessions Judge-V, Jehanabad, which forms a part of this application at Flag-R, in which it is mentioned that out of eight prosecution witnesses, five have been examined

Patna High Court CR. MISC. No.22371 of 2021(3) dt.16-11-2021 2/2 and further four months time is expected for conclusion of the pending trial.

In view of the aforesaid report, this Court is not inclined to enlarge the petitioner on regular bail at this stage. Accordingly, the prayer for bail of this petitioner is rejected.

However, it is made clear that if the trial is not concluded within six months from the date of this order, the petitioner is at liberty to renew his prayer for grant of regular bail.

With the aforesaid observation, this criminal application is disposed of.
