JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Buxar Mahila P.S. Case No. 66 of 2022, registered for the offences punishable under Sections 419, 420, 376 of the Indian Penal Code read with Section 4/8 POCSO Act and Sections 3, 4, 5, 7, 9 Immoral Traffic Prevention Act 1956.

As per allegation, the police got an information that the proprietors of hotel Anita, hotel Paradise and hotel Vaishnavi were engaged in immoral trafficking. On raid, a number of teenagers were arrested from different rooms. The petitioner was also arrested from hotel Anita.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.14383 of 2023(2) dt.19-05-2023 2/2 that the petitioner is aged about 20 years. He is innocent and has falsely been implicated in this case. Even if the case is assumed to be true, it is nothing, but a case of adolescent infatuation. He has submitted further that other co-accused persons have been granted bail by the coordinate Benches of this Court. He is under custody since 29.12.2022.

Considering the above-mentioned facts and circumstances as well as the clean antecedent and the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-Vith-cumSpecial Court POCSO Act.s in connection with Buxar Mahila P.S. Case No. 66 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
