The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 and 506/34 of the Indian Penal Code.
It is alleged that the petitioner took Rs.3,31,204/- and subsequently Rs.18,100/- for getting the mobile tower installed, but the petitioner failed to give share in profit of the contract.
It is submitted by learned counsel for the petitioner that the accusation has been levelled due to the
Patna High Court Cr.Misc. No.6261 of 2016 (2) dt.09-02-2016 2/2 personal grudge and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation arising out of contractual relationship between the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 09 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
