JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners are languishing in custody for the offences punishable under Sections 30, 38, 47 and 48 of the Bihar Excise (Amendment) Act, 2016 and Section 414 of the Indian Penal Code.

269 liters of liquor was recovered from a vehicle on which the petitioners were also sitting. Petitioners have stated on oath that they have got no criminal antecedent and they are in custody since 20.01.2017.

Considering the entire facts of this case, let petitioners, above named, be enlarged on bail on completion of

Patna High Court Cr.Misc. No.11813 of 2017 (3) dt.19-04-2017 four months of custody on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur/Successor Court, in connection with Hajipur (Town) P.S. Case No.34 of 2017, with condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioners in this case.
