The petitioner seeks bail in a case instituted for the offences under Sections 395, 397 of the Indian Penal Code, 27 of the Arms and 3 and 4 of Explosive Act.

Prosecution allegation, in short, is that the accused persons entered into the room of the informant and looted articles as well as ornaments and cash.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.9.2019. Chargesheet/prosecution report has been submitted in this case. The petitioner is not named in the F.I.R. The name of the petitioner has transpired on the basis of confessional statement of co-

Patna High Court CR. MISC. No.9805 of 2020(3) dt.17-03-2020 2/2 accused. In course of T.I.P., the informant has not identified the petitioner though other two witnesses are said to have identified. Thus the T.I.P. itself appears to be doubtful. There is no recovery of any stolen articles from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Nagar (Champa Nagar) P.S. Case No. 194 of 2019. (Sudhir Singh, J) Pankaj/- U T
