This application for grant of anticipatory bail arises out of Laheri P.S. Case No. 300/2015, disclosing offences under sections 448, 341, 354(A), 354(B) of the Indian Penal Code. Allegedly, the petitioner is said to have entered into the house of the informant and attempted to commit rape. Learned counsel for the petitioner submits that the present Laheri P.S.Case No. 300/2015 came to be instituted on 2.11.2015 and the petitioner has been implicated merely because he has been cited as a witness in a case instituted on 7.9.2015 by the brother of the petitioner, in which the husband of the informant is an accused.

Patna High Court Cr.Misc. No.6042 of 2016 (2) dt.24-02-2016 It is stated that the petitioner has no criminal antecedent. Considering the facts and circumstances, this application is allowed.

Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Bihar Sharif in Laheri P.S.Case No. 300/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C. This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bond shall be liable to be cancelled.
