JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-02-2019 A supplementary affidavit has been filed during the course of arguments. Let it be taken on record. The petitioners seek bail in anticipation of their arrest in connection with Saharsa Sadar P. S. Case No. 507 of 2018 dated 30.04.2018 instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

After some arguments, Mr. Vikram Deo Singh, learned counsel for the petitioners seeks permission to withdraw this petition in order to surrender before the court below and seek bail.

No.10794 of 2019(2) dt.22-02-2019 2/2 Should such an application be filed, the court below shall take into account that during the course of investigation, the petitioners were noticed under Section 41 of the Code of Criminal Procedure and never misused the privilege while remaining outside the jail, and shall pass orders in accordance with law without being prejudiced with the fact that the present petition has not been entertained by this Court.
