This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 364, 365 and 120(B) of the Indian Penal Code.
The petitioner no. 1 is the wife of petitioner no. 2 whereas petitioner no. 3 is son of petitioner no. 2. The First Information Report of the concerned Hathauri P.S. Case No. 96 of 2014 is based on a complaint petition filed by the informant alleging that the petitioners had taken her son on assurance of providing a job and thereafter they did not give any information to the informant.
Patna High Court Cr.Misc. No.8446 of 2015 (3) dt.02-07-2015 2/2 Learned counsel appearing on behalf of the petitioners submits that there has been undue delay in lodging of First Information Report and the petitioners have been implicated for ulterior purpose. He has further submitted that there is no specific allegation attributed against any one of these petitioners. In view of the submission as above, let the petitioners above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Hathauri P.S. Case No. 96 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
