JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-08-2025 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State, however, no one appears on behalf of the O.P. No. 2.
2. This application, for grant of anticipatory bail, arises out of Samastipur Mahila P.S. Case No. 89 of 2023 for the offences punishable under Sections 498A, 341, 323, 504, 506, 313 and 34 of the I.P.C. and Section 3⁄4 of the Dowry and Prohibition Act.
3. As per the prosecution case, the marriage of the informant was solemnized with the petitioner in the year 2022.
Patna High Court CR. MISC. No.10706 of 2025(4) dt.20-08-2025 2/3 It is further alleged that the petitioner and the co-accused persons are alleged to have tortured the informant mentally and physically, causing miscarriage of pregnancy of the informant due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that the petitioner is the husband of the O.P. No. 2 and earlier the present matter was referred to the Patna High Court Mediation Centre by a co-ordinate Bench of this Court vide order dated 07.03.2025, though the mediation between the parties has failed, however, both the parties are residing together.
5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that both husband and wife are residing together, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Samastipur, in connection with Samastipur Mahila P.S. Case No. 89 of 2023, subject to the condition laid down
