The petitioners apprehend their arrest in Nautan P.S. Case No. 198/2014 registered for the offences punishable under Sections 304B, 201, 120B & 34and other Sections of the Indian Penal Code.
The brother of the deceased Maitun Khatoon alleged that his sister was married with accused Majid Mian, she gave birth to a child. The informant made allegation against the petitioners and other in-laws of the deceased that they all have assaulted her.
It is submitted that petitioners are
Patna High Court Cr.Misc. No.8379 of 2015 (2) dt.02-03-2015 brother-in-law of the deceased. The informant did not make any sort of specific allegation against the petitioners.
Considering the facts and circumstances, the petitioners are brother-in-law and the informant did not make any specific allegation of either assault or demand of dowry against the petitioners, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, the petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Nautan P.S. Case No. 198/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
