JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 147, 341, 323, 307, 325, 379, 504 of the Indian Penal Code.
3. As per the prosecution case, the informant deals in business of milk and on the dispute of payment of dues money, petitioners alongwith other co-accused persons abused informant and threatened to kill him. It is further alleged that on 29.03.2024 at 8:30 PM, while informant was returning home, he was surrounded by the accused persons and was brutally assaulted by them with Khanti, iron rod and lathi. Petitioner no. 1 (Sandeep Kumar) and co-accused Deepak Yadav are alleged to have assaulted informant with iron rod.

4. Learned counsel for the petitioners submits that both parties are co-villagers and due to petty dispute, Maarpeet took place. The present case is counter blast of Sahebpur Kamal P.S. Case No. 96 of 2024 dated 06.04.2024, which was lodged against informant and others. Injury, allegedly caused by petitioner no. 1, is simple in nature, whereas there is no specific allegation of overt act against petitioner no. 2.
5. Learned A.P.P. for the State and learned counsel for informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - IV, Begusarai in connection with Sahebpur Kamal P.S. Case No. 110 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
