The petitioners are apprehending arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It is alleged that the petitioner withdrew Rs.29,000/- from bank under the Indira Awas scheme which was snatched by the petitioners.

It is submitted by learned counsel for the petitioners that the present case has been filed at the instigation of enemy of the petitioner and the money has actually been withdrawn on 12.08.12 for which the complaint was filed on 30.08.2012.

Patna High Court Cr.Misc. No.10196 of 2015 (3) dt.05-05-2015 2/2 Moreover, all the complaint witnesses are hearsay witnesses. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Complaint Case No.2992 of 2012, pending before the learned Judicial Magistrate, 1st Class, Vaishali.

With the above observation, this application is, accordingly, disposed off.
