JUSTICE SANJAY KUMAR ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

The petitioner seeks regular bail in connection with Bariarpur P.S. Case No. 118 of 2016 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 25(1-B) a/26/27/35 of the Arms Act.

The informant of this case happens to be Police Officer who has alleged that four persons including this petitioner started fleeing away seeing the police party and while fleeing they resorted three firings.

Learned counsel for the petitioner submits that neither the petitioner has been arrested nor any incriminating material has been recovered from the conscious possession of

Patna High Court Cr.Misc. No.11703 of 2017 (2) dt.08-03-2017 2/2 the petitioner. The other co-accused have been granted bail by the Lower Court itself. The petitioner is custody since 11.11.2016.

Learned APP for the State opposed the submission of bail on the ground that he is involved in other cases also. Considering the nature of allegation as also the fact that none of the police sustained any injury, facts and circumstances of the case stated above, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Bariarpur P.S. Case No. 118 of 2016.
