The petitioner seeks pre-arrest bail in connection with Special Case No. 131 of 2019 arising out of Gardanibagh P.S. Case No. 603 of 2019, registered under Sections 8(c), 21(B) and 27 of the Narcotic Drugs and Psychotropic Substances Act, pending in the Court of the Additional Sessions Judge, XVI, Patna.

The accusation is that in course of checking of vehicle one person was seen in fast speed boarding on a motorcycle. On giving the signal to stop the motorcycle he started to flee away, but, on chase he was apprehended, who disclosed his name Arvind Kumar. On search, he was found in possession of 13.17 gram brown sugar (smack). The seized brown sugar is

Patna High Court CR. MISC. No.10200 of 2020(2) dt.02-03-2020 2/2 more than the small quantity, but, lesser than the commercial quantity. The petitioner has no criminal antecedent and is in custody since 11.10.2019.

Having considering the quantity of the contraband, I am inclined to grant bail to the petitioner for the present. The prayer for bail is rejected.

However, the petitioner may renew his prayer for bail after eight months.
