Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Fesar PS case no. 06 of 2022 dated 21.01.2022, disclosing offences punishable under Sections 420, 467, 468, 471, 120-B of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that petitioner obtained employment as Niyojit Teacher on the basis of fake certificate of BETET. 4.
Learned Counsel for the petitioner submits that at the time of employment, petitioner had submitted all the certificates, which was verified and after verification, the petitioner was given appointment as a Panchayat Teacher.
Patna High Court CR. MISC. No.11282 of 2025(2) dt.27-03-2025 2/2 Learned counsel further submits that on the basis of allegation of submitting fake certificate of BTET, the petitioner has been terminated from service vide letter no. 760 dated 14.03.2022 (Annexure P/2).

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that petitioner has already been terminated and the allegation against him is based upon documents, for which custodial interrogation may not be required, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Aurangabad in connection with Fesar PS case no. 06 of 2022, subject to the condition laid down under Section 482 of the Code of Criminal Procedure.
