The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506, 379, 436/34 of the Indian Penal Code, 27 of the Arms Act and 3/4 of Explosive Substances Act. The prosecution case is that on 25.07.2014 at 10.00 P.M. in the night Binda Singh, Guddu Singh and the petitioner came to the house of the informant and started abusing. Thereafter, co-accused Guddu Singh and the petitioner took away two he-goats and Binda Singh resorted to fire, which did not cause injury and co-accused Munna Singh and two unknown hurled explosives. It is further alleged that co-accused Binda Singh lit fire to the hutment of the informant.

Patna High Court Cr.Misc. No.6843 of 2016 (2) dt.15-02-2016 2/2 It is submitted by learned counsel for the petitioners that in the background of old enmity the accusation has been levelled. The specific accusation against the petitioner is of taking away the he-goats. Co-accused Munna Singh, against whom there is accusation of hurling explosives, has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 19293 of 2015.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gopalganj in connection with Gopalganj P.S. Case No. 75 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
