The petitioner is accused in connection with Sessions Trial No. 418 of 2018 arising out of Fulwaria P.S. Case No. 209 of 2017 registered under sections 302, 201 and 120(B) of the I.P.C. pending in the Court of 1st Additional Sessions Judge, Gopalganj.
Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case. She is in custody since 11.12.2017. Further submission is that she has been made accused in this case only on the basis of suspicion. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with
Patna High Court CR. MISC. No.11553 of 2019(3) dt.11-04-2019 2/2 submission that there is direct allegation of committing murder of the deceased by the petitioner in conspiracy with other coaccused persons. On perusal of records, it appears that the petitioner solemnized second marriage with another person and purchased land in her favour from the money which was sent by her husband-deceased, who used to live in abroad. Thereafter, the deceased-her husband came back India to get registered the said land in his favour. At that time, the deceased-her husband was killed in the house and his dead body was found in the septic tank. Further he submits that the witnesses have also supported the same version.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
