The petitioner seeks bail in Bagha (Bhairoganj) P.S. Case No. 343 of 2019 a case initially registered under Sections 302, 120(B), 201, 34 of the Indian Penal Code.
Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that charge sheet has been submitted under Section 304B of the Indian Penal Code and the petitioner is husband of the deceased. The onus is upon the petitioner to explain cause of death of his wife (deceased).
A report was called for from the trial court. It has been reported that charge has not been framed yet.
Patna High Court CR. MISC. No.22527 of 2021(3) dt.08-09-2021 2/2 Considering the nature of accusation, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected.
Learned trial court is directed to take necessary steps to frame charge in the case within a period of one month and conclude the trial within a period of five months from the date of framing of charge.
