====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Motihari Town P. S. Case No.383 of 2020, instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2020 and charge-sheet has been submitted.

From bare perusal of the F.I.R., it would manifest that from this petitioner two live cartridges of 7.62 bore is said to have been recovered.

Patna High Court CR. MISC. No.22900 of 2021(2) dt.16-11-2021 2/2 accused Bikki Kumar @ Babua has been granted bail by a Bench of this Court vide order dated 26.10.2021 passed in Cr. Misc. No.18236 of 2021 and co-accused Nitesh Kumar has been granted bail by an another Bench of this Court vide order dated 01.09.2021 passed in Cr. Misc. No.20035 of 2021. Learned A.P.P. vehemently opposes the prayer. Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran in connection with Motihari Town P. S. Case No.383 of 2020. The application stands allowed.
