JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-09-2015 The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307, 337, 324, 34 of the Indian Penal Code. The prosecution case is that all the accused persons surrounded the informant when petitioner No. 3 Sudhir Singh and petitioner No. 4 Ramesh Singh started pressing the neck with lathi, co-accused Jitendra Singh caused injury with teeth bite on the left side of the nose and petitioner No. 2 Ganesh Singh assaulted with brick on the head of the informant. The further case of the informant is that earlier also the informant was assaulted for which Itarhi P.S. Case No. 153 of 2014 was registered.
It is submitted by learned counsel for the petitioners that injury report reflects no visible injury caused to

Though petitioners are accused in two other cases but one case was lodged by the present informant and another by the mother of the present informant. Considering the accusation not being corroborated by the medical opinion, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Itarhi P.S. Case No. 153 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
