JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. The petitioners seek bail in connection with Jogbani P.S. Case No. 18 of 2022 instituted for the offences under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioners submits that the petitioners are in custody since 24.01.2022, are persons with clean antecedent and charge-sheet has been submitted in the case.
Allegation is of recovery of 97.5 litres of liquor from plastic bags.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.11502 of 2022(2) dt.11-03-2022 2/2 petitioners were mere passerby and came to be implicated when search was made and had absolutely no connection with the plastic bag or the liquor.
Learned A.P.P. for the State opposes the prayer for bail of the petitioners.
Considering the fact that the petitioners are in custody, are persons with clean antecedent and charge-sheet has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-II, Araria in connection with Jogbani P.S.
