The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, the F.I.R. named accused persons including this petitioner and 15-20 unknown persons confronted with police personnel by creating blockage in movement and thereafter, assaulted the police party and snatched police paper. It is further alleged that co-accused Mosabbir caught the informant by his neck with a view to kill him and got released co-accused Md. Jahid.
It is submitted on behalf of petitioner that specific allegation of assault is against other co-accused persons. So far
Patna High Court CR. MISC. No.11437 of 2022(2) dt.11-08-2022 2/2 as this petitioner is concerned, he is only alleged to be member of the mob and there is no allegation of overt act against him. Petitioner claims clean antecedent.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Jokihat (Mahalgao) P.S. Case No. 594 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
